dential S You engage Steve wesonga , dba Champions property Tax LLC to represent you in protesting your property taxes and you agree to pay Champions Property Tax a contingency fee equal to 45% of your Estimated Tax Savings achieved by Champions Property Tax through administrative hearings for the protested tax year. “Estimated Tax Savings” for a given protested tax year are defined as follows:
Subtract your property's final assessed value for that year from its initial assessed value, then multiply the difference by the previous year's total tax rate. The resulting number is the Estimated Tax Savings used to calculate the contingency fee.
Sample Calculation:
If the initial assessed value is $100,000, the final assessed value achieved by Champions Property Tax is $90,000, and the prior year's tax rate is 3%, then the Estimated Tax Savings are 3% of the $10,000 reduction, or $300. The fee due to Champions Property Tax would be 45% of the Estimated Tax Savings, or $135, based on the assumptions for this sample calculation. This is a sample calculation and not a fee.
Appeals:
If you are not satisfied with the reduction in your taxes, then you and Champions property Tax may mutually agree to pursue arbitration or a judicial appeal. If you and Champions Property Tax agree to pursue arbitration or a judicial appeal, then you agree to pay Champions Property Tax a contingency fee of 50% of Estimated Tax Savings resulting from the arbitration or judicial appeal, as described above. To calculate the arbitration or judicial appeal fee, the initial assessed value for the protested tax year is the assessed value set for that year by the Appraisal Review Board, and the final assessed value is the assessed value after the conclusion of the arbitration or judicial appeal.
Terms & Limitations:
You acknowledge that Champions Property Tax has given no assurances regarding the outcome of any hearing, arbitration or appeal. If Client fails to timely provide information or documents to Champions Property Tax, Champions Propert Tax shall have no claim against client for damages. If Champions Property Tax fails to provide the services as listed herein, our liability for any and all claims is limited to the lesser of: a.) The amount of fees paid by you for the tax year in question on the property in question, or b.) $100.00. Client is engaging Champions Property Tax as a contractor and Champions Property Tax' liability as a fiduciary is limited by the terms of this agreement. This document represents the entire agreement between you and Champions Property Tax. In making this agreement, neither party has relied on any representation or agreement that is not expressly stated in this agreement. This agreement can be amended only by a written document signed by
both parties. By engaging Champions Property Tax, you authorize us to execute an Appointment of Agent on your behalf. In addition to the above services for hire, Champions Property Tax will, upon request, provide no-cost assistance with obtaining, revising and renewing homestead exemptions. Payment in full for services are due within thirty (30) days of the date of Champions Property Tax' invoice. Beginning thirty days after the invoice date, you agree to pay interest on the unpaid balance at a rate equal to the lesser of the maximum lawful interest rate allowed by applicable Texas law or eighteen percent per annum, compounded annually. Estimated Tax Savings are calculated for the purpose of determining fees for services rendered in prior, current, and future years by reference to assessed property values, without consideration of any applicable tax exemptions (including but not limited to homestead or over sixty-five exemptions). If you have been granted an over sixty-five exemption with respect to your property, Champions Property Tax will reduce its contingency fee for all future services for that property to 25% of your Estimated Tax Savings, as defined above, upon receipt of proof of the exemption. If you are an entity, then the individual signing for you represents that he or she is duly authorized and empowered to enter into this agreement. This agreement supersedes all prior agreements between you and Champions Property Tax and will remain in effect until canceled by either party with a 30-day prior written notice. Your signature below or on an Appointment of Agent form naming Champions Property Tax to represent you on property tax matters will serve to engage Champions Property Tax under the terms of this Service Agreement.
